Alternative Dispute Resolution (ADR)

The Foothill SELPA and our member districts are committed to fostering collaborative relationships between families and school districts to support the success of all students. When disagreements arise regarding a student’s special education program, Alternative Dispute Resolution (ADR) provides a voluntary, effective, and confidential process to resolve concerns while preserving positive working relationships.

What is Alternative Dispute Resolution?
ADR is an informal and non-adversarial approach designed to help families and school districts resolve disagreements regarding a student’s Individualized Education Program (IEP). Through structured dialogue, facilitated discussions, and problem-solving strategies, ADR helps both parties reach mutually agreeable solutions without the need for formal legal proceedings.

ADR Services Offered by Foothill SELPA and our LEAs
We offer a range of ADR services to support families and districts, including:

  • Facilitated IEP Meetings: A neutral facilitator assists the IEP team in communicating effectively and working collaboratively to develop an appropriate plan for the student.
  • Mediation Conferences: A trained mediator guides a structured conversation to help both parties identify concerns, explore options, and develop mutually satisfactory solutions.
  • Resolution Sessions: Informal meetings provide an opportunity for families and districts to discuss and resolve issues before proceeding to formal legal action.

When to Consider ADR
ADR is available at any stage of the IEP process when disagreements occur. It is most effective when used early in the dispute to prevent escalation and maintain a collaborative working relationship.
